Eric settled a wrongful death case for $3 million that was mediated before Hon. Russell Bostrom (Ret.). The decedent, a father of two adult sons, was hit on his motorcycle by a left turning vehicle.
Eric and his colleague, Dan Robinson, co-tried a jury trial resulting in a $3 million unanimous jury verdict. Eric's 60-year-old client was struck by an aluminum rod at a Floor & Decor store by a customer driving a handicapped electric cart with it horizontally protruding 6 feet out one side. The carrier offered the $300,000 policy limits too late. With interest and costs, the verdict will exceed $3,600,000.

ORANGE COUNTY, CA – A $3 million unanimous verdict was returned April 29, 2019, in a personal injury matter represented by counsel Eric Traut, Partner at Traut Firm and co-counsel Daniel Robinson, of Robinson Calcagnie, on behalf of a retail employee who sustained serious injuries to his neck and carotid artery.
After five days of trial and three hours of deliberation, the plaintiff was awarded medical expenses, lost income, and more than $2 million for past and future pain and suffering. The injuries required fusion of his spine after the plaintiff was struck by an aluminum 8-foot piece of trim by the defendant customer who was driving an electric cart in a retail store. The trial was presided over by Hon. John Gastelum in Orange County Superior Court. A big turning point in this matter came when the defendant was identified following a court order which required the store to provide information that led to the identity of the defendant customer.
